## Article 1 — Purpose and Acceptance
The website **alrezam.com** (hereinafter referred to as "the Site" or "the Service") is operated by Al Rezam. The terms "we," "our," and "us" refer to Al Rezam.
These Terms of Use ("TOU") govern access to and use of the Site, including all information, tools, content, and services provided therein.
By accessing or using the Site, you agree to be bound by these TOU. **If you do not agree to these terms, you must not use the Site.**
These TOU apply to all users of the Site: visitors, customers, suppliers, merchants, content contributors.
Any new features or tools added to the Site are also subject to these TOU.

## Article 3 — Access to the Site and Capacity
By accepting these TOU, you declare that you have reached the age of majority in your country of residence, or that you have the authorization of a parent or legal guardian, and that you have the legal capacity to enter into a contract.
Access to the Site is provided free of charge. The costs of accessing and using the telecommunication network remain your responsibility.
We strive to keep the Site accessible at all times, without being obliged to do so. Access may be suspended, particularly for maintenance, updates, or in cases of force majeure.

## Article 4 — Lawful Use of the Site

## Article 5 — Refusal of Service
We reserve the right to refuse or cancel an order, or to restrict access to the Service, **for a legitimate reason**, including:
- suspicion of fraud or fraudulent payment method;
- unresolved prior dispute;
- an abnormal order compared to the quantities usually ordered by a consumer;
- clearly erroneous or incomplete contact information;
- violation of these TOU;
- product unavailability or inability to deliver to the requested geographical area.
> *In accordance with Article L121-11 of the Consumer Code, a refusal to sell to a consumer cannot be opposed without legitimate reason.*
We also reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

## Article 6 — Transmission Security
You understand that your content (excluding credit card information) may be transferred unencrypted and involve: (a) transmissions over various networks; and (b) technical adaptations necessary to connect networks or devices.

## Article 8 — Modifications to the Service and Prices
The prices of our products are subject to change at any time. **The price applicable to an order is the one displayed at the time of its validation** (see GTC, Article 4).
We reserve the right to modify or discontinue the Service, or any part thereof, at any time.
We shall not be liable for any price modification or for any modification, suspension, or discontinuation of the Service, subject to orders already validated and paid, which remain governed by the GTC in force on the day of the order.

## Article 9 — Products and Services
Certain products may be available exclusively online, in limited quantities.
We strive to present **descriptions, photographs, and images** of products as accurately as possible. However, we cannot guarantee the precise display of colors on your screen, nor the absence of slight variations inherent in natural materials.
We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction, as well as to limit the quantities offered or discontinue the sale of any product.

## Article 10 — Accuracy of Account and Billing Information
You agree to provide accurate, complete, and current purchase and account information, and to update it (email address, shipping and billing address, payment method) so that we can complete your transactions and contact you as needed.
If we modify or cancel an order, we will attempt to notify you via the email address or phone number provided at the time the order was placed.

We may provide you with access to third-party tools over which we neither monitor nor have any control or input.

- does not infringe on the rights of third parties (copyright, trademarks, privacy, right to image, personality rights);
- does not contain any illegal, abusive, defamatory, obscene, discriminatory, or threatening elements;
- does not contain any viruses or malicious code;

### 13.2 License to Use
By publishing Content on the Site or transmitting it to us, you grant us a **non-exclusive, free, and worldwide license** to use this Content, including the rights to reproduce, display, adapt, and translate it, **solely for the purpose of promoting and operating the Site and our social media accounts**, on any digital and print medium, **for the legal duration of copyright protection**.
This license is granted in accordance with Articles L131-1 et seq. of the Intellectual Property Code. You may at any time request the removal of Content concerning you by writing to alrezam.com@gmail.com.
We are not obligated to: (1) maintain the confidentiality of Content; (2) pay you any compensation for it; (3) respond to it.
### 13.3 Moderation
We may, without being obligated to do so, remove any Content that we deem illegal, offensive, threatening, defamatory, obscene, infringing, or contrary to these TOU.
### 13.4 Customer Reviews
When customer reviews are displayed on the Site, we specify whether they are subject to control and, if applicable, the methods of such control, in accordance with Articles L111-7-2 et seq. of the Consumer Code. We do not remove a review solely because it is negative.

## Article 15 — Errors, Inaccuracies, and Omissions
The Site may contain typographical errors, inaccuracies, or omissions relating to descriptions, prices, promotions, shipping costs, delivery times, or product availability.
We reserve the right to correct these errors and update the information at any time.
**In the event of an obvious pricing error**, we reserve the right to cancel the order concerned and fully refund the Customer, under the conditions of common law (error on the substance, articles 1132 et seq. of the Civil Code). An obvious error is understood as a price whose erroneous nature cannot escape a normally attentive buyer.

## Article 16 — Prohibited Uses
In addition to other prohibitions set forth in these TOU, you are prohibited from using the Site or its content:

- (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
- (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- (f) to submit false or misleading information;
- (g) to upload or transmit viruses or any malicious code;
- (h) to collect or track the personal information of others;
- (i) to spam, phish, pharm, pretext, spider, crawl, or scrape in an unauthorized manner;
- (j) for any obscene or immoral purpose;
- (k) to interfere with or circumvent the security features of the Site.
We reserve the right to terminate your access to the Service for violating any of these prohibited uses.

## Article 17 — Intellectual Property
All elements of the Site — texts, visuals, photographs, videos, logos, trademarks, graphic elements, code, structure, and layout — are the exclusive property of Al Rezam or are subject to a license of use.
Any reproduction, representation, adaptation, translation, extraction or exploitation, in whole or in part, by any process and on any medium whatsoever, is strictly prohibited without prior written authorization, and constitutes an infringement punishable by articles L335-2 and following of the Intellectual Property Code.

## Article 18 — Warranties and Liability
### 18.1 Website Operation
We are bound by an **obligation of means** regarding the operation of the Website. We do not guarantee that access to the Website will be uninterrupted, error-free or delayed, nor that the results obtained from its use will be accurate or reliable.
We cannot be held liable for:
- an interruption, malfunction or unavailability of the Website;
- damage resulting from the use of the Internet (data loss, intrusion, virus);
- a case of force majeure as defined in Article 1218 of the Civil Code.
### 18.2 Limits of this clause
> **These stipulations do not in any way limit:**
> - the **legal guarantee of conformity** (articles L217-1 and following of the Consumer Code);
> - the **legal guarantee against hidden defects** (articles 1641 and following of the Civil Code);
> - the Seller's liability for the **proper performance of the sales contract**, including **delivery** and **transfer of risks** (article L216-4 of the Consumer Code);
> - liability in case of **fraud, gross negligence or bodily injury**;
> - any liability that the law does not allow to be excluded or limited.

> *In accordance with Article R212-1 of the Consumer Code, any clause whose purpose or effect is to remove or reduce the right to compensation for damage suffered by the consumer in the event of a professional's breach of one of their obligations is deemed unwritten.*
### 18.3 Professional Clients
With regard to professional Clients, our liability is limited to direct and foreseeable damages, and capped at the amount of the order concerned. Indirect damages (loss of turnover, profit, customers, image or data) are excluded.

## Article 19 — Indemnification *(Professional Clients only)*
The professional Client undertakes to indemnify Al Rezam, its directors, employees, subcontractors and service providers against any claim, demand or action by a third party, including reasonable defense costs, resulting from a breach by them of these TOU or the rights of a third party.
> *This article does not apply to consumers, as such a clause would be deemed unwritten with regard to them.*

## Article 20 — Suspension and Termination
These TOU remain in effect as long as you use the Website.
You may stop using the Website at any time.
In the event of a manifest breach of these TOU, we may suspend or terminate your access to the Service. Except in cases of urgency or serious breach (fraud, security breach, unlawful content), you will be notified beforehand and given the opportunity to present your observations.
**Termination of your access to the Website does not affect orders already validated and paid for, which remain executed in accordance with the GTC.** Obligations entered into before termination remain in force.

## Article 21 — Severability and Entirety
**Severability.** If any provision of these TOU is deemed illegal, void or unenforceable, it shall be deemed unwritten without affecting the validity of the other provisions.
**Non-Waiver.** The failure to exercise a right provided herein does not constitute a waiver of that right.
**Entirety.** These TOU, the GTC and the Privacy Policy constitute the entire agreement between you and us regarding the use of the Website.
**Interpretation.** In accordance with Article L211-1 of the Consumer Code, in case of doubt, clauses shall be interpreted in the sense most favorable to the consumer.

## Article 22 — Applicable Law and Disputes
These TOU are governed by **French law**.
**Prior complaint.** Any complaint must be addressed to alrezam.com@gmail.com in order to seek an amicable solution.
**Mediation.** *(Consumers)* In accordance with Article L612-1 of the Consumer Code, you may use a consumer mediator free of charge. The mediator's contact details are provided in Article 13 of the [GTC](/pages/conditions-generales-de-vente).
**Jurisdiction.** *(Consumers)* You may choose to bring a claim before the court of your domicile, the place of actual delivery of the product, or any territorially competent court under the Code of Civil Procedure. *(Professionals)* Exclusive jurisdiction is attributed to the courts of Paris.
